Welcome to the websites of High Altitude Partners LLC ("High Altitude Partners," "we," "us," or "our"), a Colorado limited liability company. These Terms of Service ("Terms") govern your access to and use of highaltitudepartners.com and highaltituderecruiting.com (together, the "Sites").
By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, please do not use the Sites.
These Terms apply to your use of the Sites only. Any executive search, recruiting, or consulting services we provide to clients or interactions with candidates in an active search are governed by separate written agreements and communications, not by these Terms.
You must be at least 18 years old and able to form a legally binding contract to use the Sites. By using the Sites, you represent that you meet these requirements.
The Sites provide general information about High Altitude Partners, our services, our approach to executive search in the consumer packaged goods and food and beverage industries, and related content such as articles, resources, and a contact form. The Sites are informational. Submitting a message through the contact form does not create a client, candidate, employment, or agency relationship between you and High Altitude Partners.
When you submit information through our contact form, you agree that the information you provide is accurate and that you have the right to share it with us. We will use that information as described in our Privacy Policy. We may follow up with you by email or phone in response to your message.
Please do not submit confidential, sensitive, or proprietary information through the contact form. If we end up working together, we will establish an appropriate channel for exchanging that kind of information.
You agree to use the Sites only for lawful purposes and in a way that does not infringe the rights of others or restrict anyone else's use of the Sites. You agree not to:

We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Sites for your personal, non-commercial, informational use. All other rights are reserved. You may not use our name, logos, or content for any commercial purpose without our prior written consent.
The Sites may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse or assume any responsibility for the content, products, services, or practices of any third party. Your use of third-party sites is at your own risk and subject to their terms and policies.
The Sites and all content on them are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, High Altitude Partners disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the fullest extent permitted by law, High Altitude Partners and its members, managers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or related to your use of the Sites, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the Sites will not exceed one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless High Altitude Partners and its members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Sites, your violation of these Terms, or your violation of any rights of another person or entity.
We may modify, suspend, or discontinue all or any part of the Sites at any time without notice. We may also update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Sites after the changes take effect constitutes your acceptance of the updated Terms.
These Terms and any dispute arising out of or related to them or the Sites are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. You agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in Denver, Colorado, and you consent to the personal jurisdiction of those courts.
We may suspend or terminate your access to the Sites at any time, for any reason, without notice. The sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and High Altitude Partners regarding your use of the Sites.
